Owed & Found Terms of Service

1. Agreement to these Terms
By creating an account, checking the acceptance box at signup, or using the Owed & Found website or applications (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms; if we make material changes, we will require you to review and accept the updated Terms at your next login before continuing.
2. What Owed & Found is, and what it is not
Owed & Found helps you search publicly available government and institutional records for money that may be owed to you (such as unclaimed property, refunds, matured bonds, pensions, and back wages), prepare claim information, and track claim progress.
Owed & Found is not a government agency. Owed & Found is not a law firm and does not provide legal advice. Owed & Found is not a financial advisor and does not provide investment or financial advice. Recovery of any funds is not guaranteed. Search results indicate possible matches only; final eligibility and payment are determined solely by the government agency or institution that holds the funds. Money from any successful claim is paid to you directly by that agency or institution. Owed & Found never takes custody of your recovered funds.
3. Eligibility
You must be at least 18 years old and a resident of the United States to use the Service. By using the Service you represent that the information you provide is accurate and that you are the person you claim to be.
4. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Plans, billing, and cancellation
Free Scan ($0). Searching, viewing possible matches with dollar amounts where available, and links to official records are free. We never charge to search.
Claim Copilot Radar ($3.99/month). A paid subscription that includes pre-filled claim forms, step-by-step document checklists, stall alerts and follow-ups, automatic recurring re-scans, and payout tracking. Billing is processed by our payment provider (Stripe). Subscriptions renew automatically each month until cancelled. You may cancel at any time in Settings or via the billing portal; cancellation takes effect at the end of the current billing period. Except where required by law, payments already made are non-refundable; if you believe you were charged in error, contact us at concierge@owedandfound.com and we will review in good faith.
Estate Concierge. A custom-priced service for executors and heirs, agreed in a separate written engagement before any work begins.
We may change subscription pricing with at least 30 days' notice; changes apply at your next renewal.
6. How claim filing works (you stay in control)
The Service prepares claim information and, where available, pre-fills official claim forms for your review. Nothing is submitted to any agency without your approval. For any assisted filing session: you review every field; you personally complete any field requiring your Social Security number; you personally complete any identity verification or CAPTCHA; and you personally take the final submission action. We record your confirmation of these steps as part of your claim history. You are responsible for the truthfulness and accuracy of every claim you submit or authorize.
7. Searches for family members
You may optionally ask the Service to search for possible claims belonging to family members. You may only do so with a good-faith basis and, for living adults, you should have their permission. Search results for family members are informational. Filing a claim on behalf of another adult requires that person's own approval and identity verification, or legal authority you hold (such as executorship, power of attorney, or guardianship). You represent that you will not use family search results to file claims you are not legally authorized to pursue.
8. Accuracy of information; honest results
We display amounts and details as reported by the underlying source, verbatim where possible. Where a source reports a range or withholds an amount, we say so rather than estimate. Matches are possibilities, not confirmations. We do not fabricate results. Sources update their records on their own schedules; a match may no longer be available when you pursue it.
9. Acceptable use
You agree not to: use the Service to search for or claim funds you have no good-faith basis to believe are yours or that you are authorized to pursue; impersonate any person; submit false information to any government agency through or in connection with the Service; probe, scrape, reverse engineer, or disrupt the Service; use the Service for any unlawful purpose; or resell access without our written agreement.
10. Documents you upload
You may upload documents (such as proof of address) to support your claims. You grant us a limited license to store and process those documents solely to provide the Service. You represent you have the right to upload them. You can delete your documents at any time in the app.
11. Optional partner programs (opt-in only)
We may in the future offer optional programs connecting you, at your request, with (a) licensed professionals in your state who can handle claims for you for their own disclosed fee, or (b) third-party funding companies that may offer you an advance on a filed claim for their own disclosed terms. These programs are strictly opt-in. We will never share your personal information with these third parties unless you have explicitly enabled the relevant option and consented to the specific introduction. Any engagement or funding agreement is between you and that third party; we are not a party to it, we do not lend money, and we do not hold your funds. We may receive a referral or origination fee from such third parties, which we will disclose.
12. Third-party services and links
The Service links to official government and institutional websites and relies on third-party providers (including hosting, authentication, payments, and email). We are not responsible for the content, availability, or practices of third-party sites or services. Your use of an official agency's website is governed by that agency's terms.
13. Intellectual property
The Service, including its software, design, text, and marks, is owned by [OPERATING ENTITY, INC.] or its licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. Public records themselves are not our property.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SEARCH RESULTS ARE COMPLETE OR ACCURATE, THAT ANY CLAIM WILL SUCCEED, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [OPERATING ENTITY, INC.] AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR EXPECTED RECOVERIES, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Dispute resolution; arbitration; class waiver
[COUNSEL REVIEW REQUIRED: enforceability and required carve-outs vary by state.] Except for small-claims matters and injunctive relief, any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and we each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing concierge@owedandfound.com within 30 days of first accepting these Terms.
17. Indemnification
You agree to indemnify and hold harmless [OPERATING ENTITY, INC.] from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your submission of false information to any agency, or your pursuit of claims you were not authorized to pursue.
18. Termination
You may close your account at any time. We may suspend or terminate your access for violation of these Terms or unlawful use, with notice where practicable. Sections that by their nature should survive (including 8, 10, 13-17) survive termination.
19. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except as preempted by federal law (including the Federal Arbitration Act).
